These Terms of Service ("Terms") govern your access to and use of Wicked Hybrids ("we", "us", "our"), available at wickedhybrids.com. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

1. Eligibility

You must be at least 13 years old to use Wicked Hybrids. By using the service you represent that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Accounts

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@wickedhybrids.com if you suspect unauthorised access.

You may not create accounts using automated means, impersonate other people, or provide false registration information.

3. Token System and Payments

Daily tokens are provided free of charge and reset every 24 hours. Unused daily tokens carry over; the balance only resets when it reaches zero.

Purchased tokens are acquired through our payment provider (Stripe) at the prices listed on the Tokens page. Purchased tokens never expire and are tied to your account.

Refunds. Because token purchases are used to trigger AI generation that incurs immediate third-party costs, all token purchases are final and non-refundable, except where required by applicable law. If you believe a purchase was made in error or fraudulently, contact us within 14 days and we will review your case.

We reserve the right to adjust token prices and package sizes at any time. Changes will not affect tokens already purchased.

4. AI-Generated Content

Wicked Hybrids uses third-party AI services (Google Gemini, Google Veo) to generate images and videos. You acknowledge that:

• AI outputs are non-deterministic. We cannot guarantee any specific result from a generation.
• If generation fails or produces an unusable result, the token cost may still be consumed. We will make reasonable efforts to refund tokens for clear service failures.
• AI-generated content may occasionally be unexpected or imperfect. We do not warrant the quality, accuracy, or fitness of generated outputs.
• You are responsible for ensuring that the animal selections you use as generation inputs do not infringe third-party intellectual property rights.

5. User Content

You retain ownership of the hybrid creatures, backgrounds, and videos you generate using the service. By posting content to the Feed or making your creatures publicly visible, you grant Wicked Hybrids a worldwide, royalty-free, non-exclusive licence to display, reproduce, and distribute that content as part of operating the service (e.g., showing your hybrids on the Feed, in promotional materials for the platform).

You may not post content that is unlawful, hateful, sexually explicit, harassing, or that infringes the intellectual property rights of others. We reserve the right to remove any content that violates these Terms without notice.

6. Prohibited Uses

You agree not to:

• Use the service for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, scrape, or extract data from the platform in bulk
• Use automated scripts, bots, or tools to consume tokens or interact with the service at scale
• Circumvent any rate limits, access controls, or authentication mechanisms
• Upload or submit content designed to harm, exploit, or deceive other users
• Attempt to manipulate the token system, exploit bugs for unfair advantage, or resell tokens

7. Intellectual Property

The Wicked Hybrids name, logo, website design, and all platform code are our exclusive property. Nothing in these Terms grants you any right to use our trademarks or branding.

The base animal images provided in the creature library are curated by us and are for use within the platform only — they may not be downloaded or used outside the service.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WICKED HYBRIDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may close your account at any time by contacting us. Purchased token balances are forfeited upon account termination for violations of these Terms.

11. Changes to These Terms

We may update these Terms from time to time. The "Effective date" at the top reflects the most recent revision. Continued use of the service after a change constitutes acceptance of the updated Terms. For material changes, we will make reasonable efforts to notify you (e.g., a notice on the site).

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.
